Terms & Conditions
Article 1 – Obligations of the driving school
1.1 The driving lessons are provided by an instructor who meets the requirements of the Motor Vehicle Driving Instruction Act (WRM) and has a valid WRM authorization pass.
1.2 The driving school strives to ensure that the student receives lessons from the same instructor as much as possible during the training, to ensure progress and continuity.
1.3 The instructor will regularly inform the student about their progress, and at least once every five practical lessons. This will also indicate how the progress compares to the exam requirements.
1.4 The entire agreed lesson time will be used for practical lessons, unless there are unforeseen circumstances or another reasonable reason.
1.5 Within two weeks of payment of the exam fee, the driving school will reserve the practical exam or test with the competent examination agency (such as the CBR).
1.6 Students will generally take the practical exam in the car they used for their lessons. In exceptional circumstances, such as force majeure, an equivalent car may be used.
1.7 If a lesson cannot take place due to force majeure (such as the instructor’s illness, traffic delays, or extreme weather conditions), the driving school will inform the student as soon as possible and reschedule. In this case, no refund or compensation is due.
1.8 The driving school has adequate business and liability insurance.
1.9 The driving school informs the student about any medical conditions or circumstances that may affect driving ability or the right to obtain a driving license.
1.10 The driving school informs the student that his or her residence status may affect obtaining a driving license in the Netherlands.
1.11 The student is advised that he or she is obliged to report if he or she has been denied the right to drive a motor vehicle.
Article 2 – Obligations of the student
2.1 The student must be at least 16.5 years old to take practical lessons. The student must carry valid identification during each driving lesson.
2.2 The student is required to be ready for the lesson at the agreed time and location. If the student is late, the instructor will wait for a maximum of 15 minutes. If the student is not present within this time, the lesson will be canceled and the full fee will be charged.
2.3 Driving lessons can be cancelled or rescheduled free of charge up to 48 hours in advance. In case of cancellation within 48 hours, the driving school reserves the right to charge the full lesson price in connection with the reserved time. If there is demonstrable force majeure or special circumstances, at the discretion of the driving school.
2.4 The student is obligated to inform the driving school fully and truthfully prior to lessons about:
• Medical or psychological conditions that may affect driving ability;
• Use of medications that may affect driving ability (as stated in the package insert);
• Alcohol or drug use;
• Any driving ban or suspension of the driving license.
2.5 If it appears that the student has withheld or provided incorrect information as stated in Article 2.4, the driving school has the right to immediately terminate the lesson agreement without refunding any tuition fees already paid. The driving school may also recover any resulting damages or liability from the student.
Article 3 – Payment and rates
3.1 Individual lessons must be paid for in cash or digitally immediately before the lesson, unless otherwise agreed.
3.2 For lesson packages, the first installment must be paid in full before the start of the first driving lesson. The remaining balance must be paid no later than once half of the package’s lessons have been completed.
3.3 The student is obligated to pay the (instalment) amount before the payment deadline. If this is not done, the driving school will send a free payment reminder after this deadline. The student will then have fourteen days after receiving this reminder to pay the outstanding amount.
3.4 If payment has not been received after this period has expired, the driving school is entitled to charge statutory interest from the moment of default.
3.5 If the driving school incurs costs to collect the debt, such as collection fees or legal costs, these costs may be passed on to the student within the statutory limits. Exceptions to this policy may be made in the student’s favor.
3.6 If a student passes early and has lessons remaining from a package, the remaining amount for those lessons will be refunded. Additional lessons taken will be charged at the regular rate.
Article 4 – Driving exams
4.1 If the student does not appear for the exam on time or misses the exam due to his/her own fault, the exam will be cancelled and the costs for a new application will be at his/her own expense.
4.2 If the CBR exam office cancels the exam due to weather(conditions), you do not have to pay for the new exam, but the driving school may charge for an additional driving lesson.
Article 5 – Termination of the lesson agreement
5.1 The driving school may terminate the lesson agreement if:
• The student has deliberately provided incorrect information (e.g., medical condition);
• The student does not cooperate with the progress of the training.
5.2 If a package agreement is terminated before completion, a refund will be made for lessons not taken, minus any lessons already taken, administration costs and exam fees paid.
Article 6 – Teaching packages
6.1 The content of a lesson package does not guarantee that the student will be ready for the exam afterward. Additional lessons may be necessary.
6.2 The validity of a lesson package is 18 months from the first lesson.
Article 7 – Indemnification and liability
7.1 The driving school bears the risk of traffic violations or injury to third parties during the lesson or exam, unless:
• Intentionally reckless driving by the student;
• Use of alcohol, drugs, or medication that may interfere with driving.
7.2 In the event of damage or fines caused by a student who is under the influence or who should have reported that he has been banned from driving, the driving school may recover the costs from the student.
Article 8 – Other provisions
8.1 Dutch law applies to all agreements.
8.2 In cases not provided for in these conditions, the driving school will decide reasonably.
